Stay Terms

These Stay Terms apply to every booking of a short stay in the Fortitude Essentials™ Mobile Access Facility™ (MAF™) Metro made through this website. The unit is supplied by Fortitude Essentials Pty Ltd (ACN 610 628 129, ABN 32 610 628 129) (“we”, “us”, “our”). “The unit” includes the equipment we supply with it.
The short version
- We deliver, set up, stock and pack down a self-contained accessible unit on a caravan park site in Western Australia. You do none of that.
- We provide accommodation and equipment only: no care, medical, nursing or support services, and no supervision. We do not ask for medical or health information.
- Your rights under the Australian Consumer Law always apply.
1. About these terms
1.1 These terms, your confirmation email, the stay page and the house rules displayed in the unit form the agreement between us. The version of these terms on our website on the date you book applies to your booking.
1.2 You must be at least 18 years old to book. If you book for someone else, you confirm that you have their authority and will give them these terms. You are responsible for everyone staying in or visiting the unit during your booking.
2. Your consumer rights
2.1 Our services, and the goods we supply with them, come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, services must be provided with due care and skill and be fit for their purpose, and goods must be of acceptable quality. If we fail to meet a guarantee, you are entitled to the remedies the law provides, which may include repair, replacement, a refund, cancelling the service and compensation for reasonably foreseeable loss or damage.
2.2 Nothing in these terms excludes, restricts or modifies those guarantees or any other right or remedy you have under law.
3. How booking works
3.1 Choose your dates and send a booking request through the stay page. No payment is taken at this stage.
3.2 We check the dates and the site and reply by email within one business day (Australian Western Standard Time). Your stay is confirmed only when our confirmation email arrives. We may decline a request, for example if the dates or the site are not available.
3.3 The confirmation email sets out the total price, how to pay and when payment is due, and we hold your dates until then. If payment is late we send a reminder; if it is still unpaid after the reminder, we may release the dates and tell you. We email a tax invoice for each payment.
4. Price
4.1 The price is $350.00 AUD per night with a two-night minimum, so the minimum total is $700.00 AUD. Prices include GST.
4.2 The total we confirm is the full price for your stay. It includes the nightly rate, delivery, set-up, pack-down, the caravan park site fee, linen and towels, and the commode if you ask for one. We do not add card surcharges, and nothing mandatory is added after the total is shown. Items you choose to use or buy during your stay (section 8) are optional.
5. Where the unit is set up
5.1 The unit is set up on a site we arrange at a host caravan park in Western Australia, and the site fee is included in your price. Other locations are not offered through the website booking system; ask us through the enquiry form at /enquire-now/ before booking if you would like to discuss one.
5.2 The park’s own rules apply alongside these terms. The park may ask for your name, contact details and vehicle registration for its occupancy register, and may charge you directly for extra vehicles, extra visitors or park services you use.
6. What we do, and what is not included
6.1 Before you arrive we tow the unit in, level it, connect power, water and waste, make up the bed with fresh linen and towels, set up the spare bed if you have asked for it, and stock the unit with the standard supplies listed on the stay page. At handover we show you how everything works. After your stay we pack down and remove the unit. You do not set up, connect, move or pack down anything, and you must not attempt to (section 9).
6.2 Check-in is from 2:00 pm and check-out is by 10:00 am, unless we agree other times with you in writing.
6.3 Fortitude Essentials™ provides accessible accommodation and equipment only. We do not provide medical, nursing, personal care, manual handling, transfer, supervision or disability support services. The unit is self-contained and unstaffed, for guests who can use it independently or with a carer or support person they arrange themselves. Support workers and carers are welcome, and count toward the overnight limit only if they stay overnight.
7. Equipment
7.1 A commode is available at no extra cost; please ask for it when you book. Equipment is cleaned, sanitised and checked before each stay, and we show you how it works at handover.
7.2 Each item of equipment, and each rated fitting in the unit (including the platform lift, the bed, the shower seat and the grab rails), has its rated load marked on it. Please respect the marked load on each item.
7.3 If anything develops a fault, stop using it and tell us; we will repair or replace it as quickly as we can. Please do not attempt repairs. Equipment stays in and around the unit and is left there at check-out in the condition it was supplied, fair wear and tear excepted.
8. Supplies, first aid kit and priced items
8.1 The standard supplies listed on the stay page are included in your price.
8.2 A first aid kit is kept in the unit. Please use it if you need it and let us know so that we can restock it. Items used from the kit are charged at the price listed on the kit.
8.3 Some items in the unit may carry a price label. They are optional. If you use or take one, it is charged at the labelled price. These charges are invoiced after your stay and are payable by the date on the invoice.
9. House rules
- Overnight limit: two people, you plus one companion or support worker on the spare bed. Children count toward this limit.
- No smoking or vaping inside the unit or on the platform lift.
- No candles, open flames, portable heaters or cooking appliances other than those supplied.
- Assistance animals are welcome and must be under your control. Ask us before you book if you would like to bring any other animal; the park’s rules also apply.
- Do not tow, unhitch, jack, re-level or relocate the unit, disconnect or reconnect power, water or waste, or tamper with the electrical, plumbing, battery or automation systems. If something is not working, tell us.
- Platform lift: one person at a time, within the marked rated load, following the instructions beside the controls.
- Keep the door path and the lift landing clear so the door can operate and you can leave quickly in an emergency.
- Follow the park’s rules and quiet hours.
- Tell us straight away about any fault or damage, using the contact details in your confirmation email.
- Leave the unit reasonably clean and tidy.
10. Our access to the unit during your stay
10.1 We may enter the unit without notice in an emergency or where we reasonably believe there is a safety risk. Otherwise we contact you and agree a time first, for example to fix a fault.
11. Cancelling or changing your booking
11.1 To cancel, use the cancellation link in your booking email or contact us through the enquiry form at /enquire-now/.
11.2 If you cancel 14 days or more before your arrival date, we refund everything you have paid us.
11.3 If you cancel less than 14 days before your arrival date, we refund everything you have paid us less the reasonable costs we cannot recover for your dates, such as a site fee already paid to the park, itemised for you. If we re-book your dates, we refund in full. These costs are our genuine estimate of our loss on a late cancellation and do not affect your rights under the Australian Consumer Law.
11.4 You can move your dates once at no charge if you ask 14 days or more before arrival, subject to availability, and you can transfer your booking to another person who agrees to these terms by telling us in writing before arrival.
11.5 If you have to cancel because of a government direction, a natural disaster, an extreme weather warning or closure of the host park, we offer you a full credit or a full refund, whichever you prefer.
11.6 We pay refunds by the method you paid with, within ten business days of confirming the cancellation.
12. If we have to cancel or change your booking
12.1 We may cancel or change a booking if the site or the unit becomes unsafe or unavailable, if weather, fire danger or road conditions make delivery, set-up or your stay unsafe, or if we cannot obtain a site, an approval or the insurance cover we need for your booking.
12.2 If we cancel, you choose a full refund of everything you paid us or a move to other available dates, and we tell you as soon as we know. If we have to cut a stay short for one of these reasons, we refund the unused nights.
13. Health, care and safety
13.1 We do not make medical claims. We do not diagnose, treat or prevent any medical condition, and nothing about the unit or our equipment replaces advice from a qualified health professional.
13.2 We do not ask for medical or health information. Please do not include medical details in your booking request or messages. If you tell us something we need to know to set up the unit for you, such as a preferred bed height, we use it only for that purpose and keep it confidential.
13.3 In an emergency, call Triple Zero (000). A card inside the unit shows the park address and site number for emergency services. If you or a guest would need help to leave the unit in an emergency, please make sure a person who can provide that help is with you.
13.4 Your confirmation email and the welcome card in the unit tell you how to reach us during your stay, including for urgent faults. This is not an emergency or care service.
14. Funding
14.1 We work with individuals who may receive NDIS funding. Holiday accommodation is often not covered by funding plans, so please check with your plan manager or funding body before you book. You are responsible for paying us whether or not any funding claim succeeds.
15. Damage and liability
15.1 Nothing in this section limits your rights under the Australian Consumer Law, or our liability for death or personal injury caused by our negligence.
15.2 To the extent permitted by law, we are not liable for indirect or consequential loss, such as travel or accommodation you book elsewhere, and we are not responsible for loss of or damage to your belongings unless it is caused by our negligence. Please lock the unit when you leave it.
15.3 You are responsible for loss or damage to the unit and equipment caused by you or your guests, beyond fair wear and tear, up to the reasonable cost of repair or replacement. You are not responsible for damage you or your guests did not cause. We photograph the unit and equipment at handover and pack-down to note their condition (never you or your guests). Before we ask you to pay for anything, we send you the photos and an itemised explanation and work through any disagreement with you first.
16. Privacy
16.1 We handle your personal information in line with our Privacy Policy at /privacy-policy/, including its sections on bookings and stays and on marketing.
17. Complaints, disputes and governing law
17.1 If something goes wrong, please contact us first through the enquiry form at /enquire-now/ or by post. We acknowledge complaints within two business days and aim to resolve them within ten business days.
17.2 If we cannot resolve your complaint, you can contact Consumer Protection WA. Nothing in these terms prevents you from doing so.
17.3 These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.
